You paid for termite protection and still you have termites. The law can help you. Alabama is pretty strong on getting you what you paid for.
Here is what I am seeing: pest control companies are great to cash your checks and talk up the protection they provide; however when a problem appears, they can be less than effective. It seems they will try most anything not to fix the problem.
Here are some of what we have heard: “It is pre-existing”, “Your contract doesn’t cover that”, “We only offered to attempt to prevent termites not to actually prevent them” — and the excuses go on and on.
There are examples of Alabama companies which actually falsified documents and even shredded incriminating evidence. The law takes this very seriously.
Let me mention one other thing we have found. Companies will sometimes use a cheaper pesticide than they tell you about. This is all to save money … for the company. The problem is when the cost saving results in major damage to your home.
Why am I making such a big deal about this? A 2017 study found Mobile to be the number one city in the nation for termite infestation.
Here is the bottom line: if you paid a company to prevent termites and you get termites, you need to talk with a lawyer. Talking to a personal injury attorney will not cost you anything.
